ISS Director, Arnoux Maré, Faces Arrest After Labour Court Rejects Bid to Set Aside Writs

Innovative Staffing Solutions (ISS) director Arnoux Maré faces arrest after the Labour Court dismissed his application to have two writs of arrest issued against him set aside.

The judgment was delivered on 28 August 2026 in a long-running legal dispute between Maré and the National Bargaining Council for the Road Freight and Logistics Industry (NBCRFLI) over compliance with the council’s Main Collective Agreement (MCA).

According to the NBCRFLI, the dismissal means the writs remain valid and stand for execution.

The two writs were issued on 21 December 2020 and 8 November 2021 following an earlier Labour Court order relating to Maré’s alleged failure to comply with undertakings concerning the registration of his business with the bargaining council.

A dispute going back years

The dispute dates back to at least 2018, when the NBCRFLI began seeking to enforce its Main Collective Agreement against the business.

According to the council, Maré was then the shareholder, sole director and controlling mind of Innovating Staffing Solutions (ISS).

The NBCRFLI says Maré undertook in 2019 that ISS would register with the council and submit monthly returns, but subsequently failed to comply.

The matter eventually reached the Labour Court.

SA Trucker reported in 2021 that the NBCRFLI had obtained a warrant of arrest after Maré was allegedly found in contempt of a court order.

Maré disputed the council’s position at the time and maintained that ISS was not operating as a Temporary Employment Service or labour broker.

SA Trucker subsequently reported on Maré’s response to the NBCRFLI’s allegations.

Court battles over the MCA continued

The legal dispute continued, with ISS challenging the NBCRFLI’s jurisdiction and its attempts to enforce the MCA.

In another Labour Court matter, ISS sought to have a CCMA demarcation award stayed while it pursued a review. The court dismissed the application, with the dispute centring on whether ISS fell within the scope of the NBCRFLI.

The legal battle continued into 2022 and 2023, with ISS maintaining that it was an outsourcing company rather than a labour broker and challenging the application of the MCA.

Maré said ISS would continue pursuing its legal options.

The NBCRFLI, however, maintained that ISS fell within its jurisdiction and was required to comply with the collective agreement.

Maré’s latest bid fails

According to the NBCRFLI’s latest circular, Maré launched an application in March 2021 seeking to have the writs of arrest set aside, arguing that he had complied with the relevant court order.

The council opposed the application.

The matter remained before the Labour Court for several years, with the NBCRFLI saying additional issues were raised during the proceedings, including a later challenge to the constitutionality of the writs.

The matter was eventually heard on 23 April 2026.

On 28 August 2026, the Labour Court dismissed Maré’s application.

The court order states that the application to set aside the two writs was dismissed and that the writs, as well as any other writs issued for failure to comply with the relevant court order, stand for execution.

The NBCRFLI welcomed the ruling, saying it remains committed to enforcing compliance with the MCA and lawful court orders.

The council also says Maré has to date made no effort to comply with the relevant court orders.

SA Trucker seeks Maré’s response

SA Trucker has made efforts to contact Maré for comment on the latest judgment and the NBCRFLI’s claims, but those efforts have so far not been fruitful.

Maré’s side of the story is important, particularly given his previous challenges to the NBCRFLI’s position and the long-running nature of the dispute.

Should Maré respond, SA Trucker will publish his response and update this article accordingly.
